El artículo aborda el antagonismo jurídico entre la acción de lesividad y su procedencia frente a actos administrativos regulares e irregulares en Ecuador, enfocándose en la tensión entre las resoluciones de la Corte Constitucional y la Corte Nacional. El problema radica en la aplicación de la acción de lesividad, especialmente en casos donde los actos administrativos presentan vicios de legalidad como fue el caso de la sentencia No. 030-18-SEP-CC. El objetivo es analizar las discrepancias jurisprudenciales y sus implicaciones en la (...) seguridad jurídica a través del principio de legalidad. El método utilizado es no experimental y explicativo, con un enfoque cualitativo basado en análisis documental y bibliográfico. Se examina la validez de los actos administrativos, los fundamentos doctrinales e históricos de la acción de lesividad, y la legislación comparada. Los hallazgos indican una falta de consenso entre las Cortes sobre la aplicabilidad de la acción de lesividad en actos administrativos irregulares. Mientras la Corte Constitucional favorece la seguridad jurídica del administrado, al permitir la acción de lesividad incluso en actos irregulares, la Corte Nacional sostiene que solo debe aplicarse en actos regulares o con vicios convalidables. Las conclusiones destacan la importancia de una interpretación coherente y uniforme de la ley para garantizar la seguridad jurídica. Esta investigación contribuye al entendimiento del derecho administrativo en Ecuador, ofreciendo una perspectiva crítica sobre la coexistencia de reglas jurisprudenciales y la práctica administrativa. E-learning is essential for effective feedback, which motivates the implementation of university infrastructures. The objective is to analyze the level of quality of e-learning in higher level students. An online survey of 1901 students was conducted. Descriptive statistics and multiple linear regression technique were used. The results indicate overall an average score of 3.34 for learning quality and satisfaction level of 66%. The model is significant (p<0.05), but the factors sex, residential area, professional career and cycle are not significant. Vinculado al proceso de degeneración de la potencia instintiva humana y su animalidad, se estableció un modelo de conocimiento, basado en el ideal metafísico y la creencia incondicional de la verdad. For the epic journey of autumn migration, long-distance migratory birds use innate and learned information and follow strict schedules imposed by genetic and epigenetic mechanisms, the details of which remain largely unknown. In addition, bird migration requires integrated action of different multisensory systems for learning and memory, and the hippocampus appears to be the integration center for this task. In previous studies we found that contrasting long-distance migratory flights differentially affected the morphological complexity of two types of hippocampus astrocytes. Recently, (...) a significant association was found between the latitude of the reproductive site and the size of the ADCYAP1 allele in long distance migratory birds. We tested for correlations between astrocyte morphological complexity, migratory distances, and size of the ADCYAP1 allele in three long-distance migrant species of shorebird and one non-migrant. Significant differences among species were found in the number and morphological complexity of the astrocytes, as well as in the size of the microsatellites of the ADCYAP1 gene. We found significant associations between the size of the ADCYAP1 microsatellites, the migratory distances, and the degree of morphological complexity of the astrocytes. We suggest that associations between astrocyte number and morphological complexity, ADCYAP1 microsatellite size, and migratory behavior may be part of the adaptive response to the migratory process of shorebirds. Estudo qualitativo exploratórios de literatura cientifica sobre ansiedade em estudantes brasileiros, objetivando identificar fatores relacionados ao desenvolvimento da ansiedade patológica. Os textos foram analisados e agrupados de acordo com análise de conteúdo. Entre os resultados encontramos o enfoque relacional que impacta o self e surge no contexto socioeconômico. Destacamos como agentes que contribuem para a ansiedade: exigência de responsabilidade e autonomia; preocupações com o futuro; não ter tempo para o lazer, ausência de familiares; ser mulher e ser homossexual. Concluímos que (...) o modelo de ensino praticado na universidade causa pressão psicológica pela grande diferença da experiência pedagógica no secundário. Completamos que a Universidade requer promover intervenções que visem o desenvolvimento emocional e cognitivo dos estudantes para que desenvolvam seu método de estudar mais eficiente, lidar melhor com suas dificuldades, e gerar estratégias para lidar com elas, além de organizar o planejamento tempo reservando horas para atividades de lazer e de interação social. INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...) written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. But in Portuguese the words god (“deus”) and dog (“cão”) are not so closely linked. In fact, there is no direct mention of “deus” in Rosa’s text: Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Both are fascinating. In Rosa’s excerpt, the rhythm is unmistakable and precise, despite, of course, the indices of hesitation: the commas, the Eh, the uncomfortable way of searching through prolongation and wait. This is the sort of paradox Rosa can engage within a sentence. W.Martinez’s does this as well, at a scale that reverberates beyond the sentence, and with one noticeable addition: deus. What may appear to be an overstep, to add such a weighted word that draws out wordplay but is, nevertheless, not in the source text, is exemplary of risk. The translation buzzes because of it. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. This isn’t so different from what Rosa says himself: The Sir look…see: the most important and beautiful, of the world, is this: that the people are not always same, still were not completed — but that they go always shifting. O senhor aprova? Me declare tudo, franco – é alta mercê que me faz: e pedir posso, encarecido. Este caso – por estúrdio que me vejam – é de minha certa importância. Tomara não fosse... Mas, não diga que o senhor, assisado e instruído, que acredita na pessoa dele?! Não? Lhe agradeço! Sua alta opinião compõe minha valia. Já sabia, esperava por ela-já o campo! Ah, a gente, na velhice, carece de ter sua aragem de descanso. Lhe agradeço. Tem diabo nenhum. Nem espírito. Nunca vi. Alguém devia de ver, então era eu mesmo, este vosso servidor. Fosse lhe contar... Bem, o diabo regula seu estado preto, nas criaturas, nas mulheres, nos homens. Até: nas crianças – eu digo. Pois não é ditado: “menino – trem do diabo”? E nos usos, nas plantas, nas águas, na terra, no vento... Estrumes. ... O diabo na rua, no meio do redemunho... Hem? Hem? Ah. Figuração minha, de pior pra trás, as certas lembranças. Mal hajame! Sofro pena de contar não... Melhor, se arrepare: pois, num chão, e com igual formato de ramos e folhas, não dá a mandioca mansa, que se come comum, e a mandioca-brava, que mata? Agora, o senhor já viu uma estranhez? A mandioca-doce pode de repente virar azangada – motivos não sei; às vezes se diz que é por replantada no terreno sempre, com mudas seguidas, de manaíbas – vai em amargando, de tanto em tanto, de si mesma toma peçonhas. E, ora veja: a outra, a mandiocabrava, também é que às vezes pode ficar mansa, a esmo, de se comer sem nenhum mal. E que isso é? Eh, o senhor já viu, por ver, a feiúra de ódio franzido, carantonho, nas faces duma cobra cascavel? Observou o porco gordo, cada dia mais feliz bruto, capaz de, pudesse, roncar e engolir por sua suja comodidade o mundo todo? E gavião, corvo, alguns, as feições deles já representam a precisão de talhar para adiante, rasgar e estraçalhar a bico, parece uma quicé muito afiada por ruim desejo. Tudo. Tem até tortas raças de pedras, horrorosas, venenosas – que estragam mortal a água, se estão jazendo em fundo de poço; o diabo dentro delas dorme: são o demo. Se sabe? E o demo – que é só assim o significado dum azougue maligno – tem ordem de seguir o caminho dele, tem licença para campear?! Arre, ele está misturado em tudo. Que o que gasta, vai gastando o diabo de dentro da gente, aos pouquinhos, é o razoável sofrer. E a alegria de amor – compadre meu Quelemém, diz. Família. Deveras? É, e não é. O senhor ache e não ache. Tudo é e não é... Quase todo mais grave criminoso feroz, sempre é muito bom marido, bom filho, bom pai, e é bom amigo-de-seus-amigos! Sei desses. Só que tem os depois – e Deus, junto. Vi muitas nuvens. Mas, em verdade, filho, também, abranda. Olhe: um chamado Aleixo, residente a légua do Passo do Pubo, no da-Areia, era o homem de maiores ruindades calmas que já se viu. Me agradou que perto da casa dele tinha um açudinho, entre as palmeiras, com traíras, pra-almas de enormes, desenormes, ao real, que receberam fama; o Aleixo dava de comer a elas, em horas justas, elas se acostumaram a se assim das locas, para papar, semelhavam ser peixes ensinados. Um dia, só por graça rústica, ele matou um velhinho que por lá passou, desvalido rogando esmola. O senhor não duvide – tem gente, neste aborrecido mundo, que matam só para ver alguém fazer careta... Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Esse Aleixo era homem afamilhado, tinha filhos pequenos; aqueles eram o amor dele, todo, despropósito. Dê bem, que não nem um ano estava passado, de se matar o velhinho pobre, e os meninos do Aleixo aí adoeceram. Andaço de sarampão, se disse, mas complicado; eles nunca saravam. Quando, então, sararam. Mas os olhos deles vermelhavam altos, numa inflama de sapiranga à rebelde; e susseguinte – o que não sei é se foram todos duma vez, ou um logo e logo outro e outro – eles restaram cegos. Cegos, sem remissão dum favinho de luz dessa nossa! O senhor imagine: uma escadinha – três meninos e uma menina – todos cegados. Sem remediável. O Aleixo não perdeu o juizo; mas mudou: ah, demudou completo – agora vive da banda de Deus, suando para ser bom e caridoso em todas suas horas da noite e do dia. Parece até que ficou o feliz, que antes não era. Ele mesmo diz que foi um homem de sorte, porque Deus quis ter pena dele, transformar para lá o rumo de sua alma. Isso eu ouvi, e me deu raiva. Razão das crianças. Se sendo castigo, que culpa das hajas do Aleixo aqueles meninozinhos tinham?! Compadre meu Quelemém reprovou minhas incertezas. Que, por certo, noutra vida revirada, os meninos também tinham sido os mais malvados, da massa e peça do pai, demônios do mesmo caldeirão de lugar. Senhor o que acha? E o velhinho assassinado? – eu sei que o senhor vai discutir. Pois, também. Em ordem que ele tinha um pecado de crime, no corpo, por pagar. Se a gente – conforme compadre meu Quelemém é quem diz – se a gente torna a encarnar renovado, eu cismo até que inimigo de morte pode vir como filho do inimigo. Mire veja: se me digo, tem um sujeito Pedro Pindó, vizinho daqui mais seis léguas, homem de bem por tudo em tudo, ele e a mulher dele, sempre sidos bons, de bem. Eles têm um filho duns dez anos, chamado Valtei – nome moderno, é o que o povo daqui agora apreceia, o senhor sabe. Pois essezinho, essezim, desde que algum entendimento alumiou nele, feito mostrou o que é: pedido madrasto, azedo queimador, gostoso de ruim de dentro do fundo das espécies de sua natureza. Em qual que judia, ao devagar, de todo bicho ou criaçãozinha pequena que pega; uma vez, encontrou uma crioula bentabêbada dormindo, arranjou um caco de garrafa, lanhou em três pontos a popa da perna dela. O que esse menino babeja vendo, é sangrarem galinha ou esfaquear porco. – “Eu gosto de matar...” – uma ocasião ele pequenino me disse. Abriu em mim um susto; porque: passarinho que se debruça – o vôo já está pronto! Pois, o senhor vigie: o pai, Pedro Pindó, modo de corrigir isso, e a mãe, dão nele, de miséria e mastro – botam o menino sem comer, amarram em árvores no terreiro, ele nu nuelo, mesmo em junho frio, lavram o corpinho dele na peia e na taca, depois limpam a pele do sangue, com cuia de salmoura. A gente sabe, espia, fica gasturado. O menino já rebaixou de magreza, os olhos entrando, carinha de ossos, encaveirada, e entisicou, o tempo todo tosse, tossura da que puxa secos peitos. E que eu merecia de ir para cursar latim, em Aula Régia – que também diziam. Tempo saudoso! Inda hoje, apreceio um bom livro, despaçado. Na fazenda O Limãozinho, de um meu amigo Vito Soziano, se assina desse almanaque grosso, de logogrifos e charadas e outras divididas matérias, todo ano vem. Em tanto, ponho primazia é na leitura proveitosa, vida de santo, virtudes e exemplos – missionário esperto engambelando os índios, ou São Francisco de Assis, Santo Antônio, São Geraldo... Eu gosto muito de moral. Raciocinar, exortar os outros para o bom caminho, aconselhar a justo. Minha mulher, que o senhor sabe, zela por mim: muito reza. Ela é uma abençoável. Compadre meu Quelemém sempre diz que eu posso aquietar meu temer de consciência, que sendo bem-assistido, terríveis bons-espíritos me protegem. Ipe! Com gosto... Como é de são efeito, ajudo com meu querer acreditar. Mas nem sempre posso. O senhor saiba: eu toda a minha vida pensei por mim, forro, sou nascido diferente. Eu sou é eu mesmo. Diverjo de todo o mundo... Eu quase que nada não sei. Mas desconfio de muita coisa. Tanta gente – dá susto de saber – e nenhum se sossega: todos nascendo, crescendo, se casando, querendo colocação de emprego, comida, saúde, riqueza, ser importante, querendo chuva e negócios bons... De sorte que carece de se escolher: ou a gente se tece de viver no safado comum, ou cuida só de religião só. Eu podia ser: padre sacerdote, se não chefe de jagunços; para outras coisas não fui parido. Mas minha velhice já principiou, errei de toda conta. E o reumatismo... Lá como quem diz: nas escorvas. Ahã. Hem? Hem? O que mais penso, testo e explico: todo-omundo é louco. O senhor, eu, nós, as pessoas todas. Por isso é que se carece principalmente de religião: para se desendoidecer, desdoidar. Reza é que sara da loucura. No geral. Isso é que é a salvaçãoda- alma... Muita religião, seu moço! Eu cá, não perco ocasião de religião. Aproveito de todas. Bebo água de todo rio... We are happy to present the Fall 2017 issue of Constellations journal. Included within are four diverse undergraduate papers ranging vastly in topic. We made a conscious effort to encourage submissions from a wide range of disciplines, provided the work could be broadly considered “historical” in scope. Interdisciplinary cooperation is something that we feel should be celebrated and promoted, and we are currently working with other student journals and organizations to bring an Arts-wide undergraduate research conference to life this spring.We (...) hope that you enjoy the variety of topics covered in this edition, and appreciate your interest and support in Constellations. During the 1970s and 1980s, political psychologists at the State University of New York at Stony Brook focused political scientists’ attention on online processing. Borrowing from the new field of social cognition in psychology, they argued that voters’ evaluations of candidates are the products of a summing up of reactions to happenings during a campaign. Voters might not remember the specific events later on, but their running tallies of reactions over the duration of the campaign would ensure that they take (...) the forgotten information into account when entering the voting booth. Later, these same scholars yet again borrowed from (a very changed) psychology, and argued that many people, especially the most politically sophisticated, try to confirm their current political evaluations—for example, by seeking out confirmatory evidence and dismissing evidence that challenges their attitudes. We ask whether online processing and motivated reasoning have the same or different implications for democratic governance, and whether the two empirical perspectives can be reconciled. (shrink)

Described as a gem in Islam, intellect can lead all individual and social behaviours towards balance, appeal and godliness. Given the utmost importance of protecting intellect in this divine religion, everything from eating and drinking to reading, listening and entertainment is thus considered haram [ viz. remains prohibited] if it makes threats to the health of mind and soul. In general, narcotics and substance abuse in all forms can have crushing and all-encompassing effects, that is, inflict heavy blows on the (...) body, soul, mind, willpower and religion in a person and consequently destroy life in the family and society. The continuation of life as well as the stability and survival of this holy institution accordingly depends on many factors, including addiction tendency (AT) and sexual dysfunction (SD). It is also obvious that the balance and optimal use of sexual instinct on the accepted path of religion will be the key to the family health and strength. Altogether, the role of AT and SD on intention to divorce (ITD) in Indonesian Muslim couples ( n = 450) was investigated in 2022 in this study, wherein one partner had previously attended addiction treatment centres over the last 6 months. The study results ultimately demonstrated that AT could induce SD and consequently raise ITD among Muslim couples. Contribution: The study results confirmed the harmful impacts of AT on SD among Muslim couples, which could increase their ITD. In view of this, it was suggested to promote religious teachings in the family to benefit from their positive effects. (shrink)

El avance de la frontera agrícola en la Provincia constituye para las comunidades locales del espacio rural una problemática que se ha incrementado desde la década de 1970. A lo largo de todo este tiempo, los conflictos emergentes por formas distintas de apropiación de los bienes de la naturaleza dieron origen a la generación de espacios de organización de las comunidades locales en toda la Provincia. En este contexto, en 2009 surge la Mesa de Tierras del Departamento Jiménez a partir (...) de la confluencia de organizaciones campesinas, comunidades locales, la Iglesia Católica y organizaciones gubernamentales y no gubernamentales. Este espacio de organización constituye un ámbito de discusión, asistencia y elaboración de propuestas ante la conflictualidad emergente por el territorio. La Mesa de Tierras ha venido desarrollando diversas acciones de resistencia: reuniones mensuales para pensar el territorio, feria de productores/as, mapeo colectivo de las comunidades, talleres para fortalecer la producción local (curtidos, queso, huerta, conservas, derivados de la algarroba, etc.), relevamiento de conflictos de tierra y fumigaciones, entre otras. Este trabajo busca sistematizar estas acciones con el objetivo de analizar las estrategias socio-comunitarias de la Mesa a partir de la construcción de una matriz. La metodología utilizada es cualitativa, aplicando las siguientes técnicas: registro y análisis de datos, observación participante y entrevistas semi-estructuradas. Su aporte se basa en visibilizar otras formas de vida y resistencia en el territorio, principalmente a través de las articulaciones con otros actores territoriales. (shrink)

The research sought to determine the prevalence of Burnout Syndrome in health teachers at a university in north-eastern Peru. The universe was made up of 69 teachers, and 41 responded to the self-administered instrument called Maslach Burnout Inventory. The results show that 14.6% present this syndrome. The highest indicator was personal fulfillment, while depersonalization and emotional exhaustion were low. According to gender, in both it was similar. According to age group, it had a greater effect in ages between 36 and (...) 51 years. Marital status was more prevalent in singles. We conclude that the prevalence of Burnout Syndrome was low. The influence that Husserlian phenomenology has exerted on Paul Ricoeur’s initial works on a phenomenology of will is a topic where specialists have achieved a mutual agreement. One of the most evident proofs of Husserlian influence on Ricoeur’s phenomenological definitions of the voluntary and the involuntary is the method of eidetic description, which privileges imagination. We believe that the relationship found within these reflections regarding imagination and will, may give us a novel perspective for rethinking the problems of education in (...) the Contemporary Age. Hence, this article will introduce some of these issues regarding education from Ricoeur’s perspective, after which we will outline a potential solution based on the scope of Ricoeurian phenomenology, whereupon the topics of imagination and will intersect. Las fronteras juegan un rol central en la anatomía y fisiología política del Antropoceno. Antes que muros que separan territorios, son membranas que comunican metabolismos sociales. Desde el marco de la ecología política contemporánea, el artículo propone el análisis de las fronteras como órganos exosomáticos: membranas multifuncionales y permeables que participan de las funciones de circulación, inmunización y crecimiento de los metabolismos sociales capitalistas.

This book is an enquiry into memory in the Western world. Specifically, memory is the framework of culture, because it links the present to the past--or tradition--and projects it into the future. For this reason, any work focusing on memory involves a double challenge: (1) to reveal the origin of concepts and (2) to glimpse the course of thoughts. This is the case of the present volume, in which the authors make several tastings of Europe's intellectual heritage, by taking into (...) account both the Greek origin of this legacy and its relevance for understanding the European philosophical heritage. In particular, these papers focus on the Aristotelian tradition, the true keystone of Europe, and on other currents of thought that have also played an essential role in the intellectual evolution of the Old Continent. In the latter field, there are contributions, for instance, on philosophical-religious traditions such as Orphism or on certain fundamental aspects of Neoplatonism both in the Classical World and in Christian authors. The volume concludes with various works on the survival of these intellectual trends from the Renaissance to the present day. Consequently, this work offers the opportunity to delve deeper into some of the aspects that define Western civilisation, observed both from its origin and its evolution over the centuries. El presente artículo busca explicar el proceso de insurrección de la guerrilla del Partido de los Pobres, liderado por el maestro rural Lucio Cabañas Barrientos en Atoyac, Guerrero. El enfoque de esta investigación busca estudiar las violencias culturales y sociales cotidianas, como parte de un proceso histórico que formó parte del fenómeno de la violencia política-caciquil. El problema-eje de esta investigación será la contrarreforma agraria iniciada durante los años cuarenta del siglo XX, que hacia los años sesenta producirá en Guerrero (...) un acentuado problema agrario cruzado por el problema de la herencia de la tierra, las tensiones en torno a linderos y los pleitos familiares y comunitarios por el usufructo del trabajo familiar o colectivo. Se verá el alejamiento institucional del Estado para intervenir en las disputas y cómo el gobierno promovía una cultura de violencia, en la que los actores dominantes podrían legitimarse con la “ley del más fuerte”. Se estudiarán diversas reglas comunitarias no escritas, que establecían como legítimo el recurso de la venganza y la justicia por propia mano. En dicho contexto de furor campesino, agravado por el agravio económico de caciques locales, y el abuso de corruptos gobernantes, se explicará el salto de la violencia social a la política; el camino que los campesinos de Atoyac seguirían para organizar una lucha armada de pobres contra ricos. This article brings together two debates in contemporary political philosophy: on the one hand, the dispute between the distributive and relational approaches to equality and, on the other hand, the field of intergenerational equality. I offer an original contribution to the second domain and by doing so, I inform the first. The aim of this article is thus twofold: (1) shedding some light on an under-researched and yet crucial question – ‘which inequalities between generations matter?’ and (2) contributing to a (...) far-reaching debate that touches upon the nature of egalitarianism. After showing that there are two key problems that fall within the scope of intergenerational equality – questions of justice between age groups and questions of equality between birth cohorts – I argue that, contrary to what the default distributive view (complete lives egalitarianism) states, some inequalities between age groups matter independently of their diachronic impact, and so partly for relational reasons. I argue that, even if we are distributive egalitarians, we must endorse the relational egalitarian conception to successfully make sense of some inequalities between age groups. I infer from this both that the putative view that the ‘relational’ conception of equality can be redescribed as distributive must be rejected and that the distributive view requires supplementation (but not necessarily displacement) by the relational view. Michel Foucault and Roberto Esposito have been two of the most influential biopolitical thinkers of the twentieth century, but their respective approaches to the relationship between life and politics do not address the main problem of the Anthropocene: the relationship between life and energy. Thus, this article analyzes the biophysical limits of biopolitics in the works of Foucault and Roberto Esposito and, to overcome these limits, it proposes to analyze the physiological assembly of the devices of power within the energetic (...) flows of social metabolisms. The article concludes that the physio-political approach to human societies allows us to overcome the biophysical limits of both Foucauldian biopolitics and Esposito's immunological paradigm. Abstract It would be puzzling if the morally best agents were not so good after all. Yet one prominent account of the morally best agents ascribes to them the exact motivational defect that has famously been called a “fetish.” The supposed defect is a desire to do the right thing, where this is read de dicto . If the morally best agents really are driven by this de dicto desire, and if this de dicto desire is really a fetish, then (...) the morally best agents are moral fetishists. This is puzzling. I resolve the puzzle by showing that on a proper understanding of the interaction between de dicto and de re moral motivation, it is not only not fetishistic, but quite possibly desirable, to be motivated by a de dicto desire to do the right thing. My argument relies partly on an appeal to a non-buck-passing account of moral rightness, according to which rightness is itself an additional reason-giving property over and above the right-making properties of an action. If this account of moral rightness is correct, then we would expect the morally best agents to exhibit de dicto moral motivation. However, since their de dicto desire acts in concert with de re desires, there is no reason to consider it a fetish. En busca de un acceso al fenómeno del amor, se propone interrogarlo conforme al tipo de atención que promueve, asumiendo y discutiendo los recursos aportados por la fenomenología husserliana, así como por las fenomenologías contraintencionales, en particular la de Waldenfels. De este modo, si para describir este fenómeno es preciso dar cuenta del fundamento afectivo de la atención, también hay que reconocer que el (...) amor es vivido como un hecho original o un acontecimiento que implica para el amante una reorientación existencial y atencional. ABSTRACT The article inquires into the attentionality inherent to love as a privileged and primordial experience of care. Seeking access to the phenomenon of love, we suggest inquiring into it according to the type of attention it promotes, drawing on and discussing the resources provided by Husserlian phenomenology, as well as by counter-intentional phenomenologies, particularly Waldenfels'. Thus, while it is necessary to account for the affective grounds of attention in order to describe this phenomenon, it is also essential to recognize that love is experienced as an original fact or as an event that entails an existential and attentional reorientation of the lover. En el presente artículo se estudia la historia de vida de una mujer que perteneció a la llamada guerrilla urbana de los “Lacandones” que operó principalmente en la Ciudad de México. Como problema-eje propongo la pregunta ¿cuáles fueron las subjetividades sociales y mandatos de género implicados en la decisión de revelarse y levantarse en armas? Se explorará el proceso de empoderamiento y el significado que para ella tuvo su participación política en la Liga Comunista Espartaco y su paso por el (...) movimiento estudiantil de 1968, situando como eje de mi problematización las dificultades que enfrentó como hija, hermana, madre-esposa y cómo las relaciones de parentesco pesaron en su práctica política como militante revolucionaria. Freedom of expression is one of the issues of concern to human societies in the contemporary world, because this issue is one of the most important basic rights of people in societies due to its special nature, and on the other hand, it is always in conflict with the authoritarian point of view. Islam accepts freedom of expression for everyone in the Islamic society, but it has specified limits and regulations for it. These restrictions and conditions, more than cumbersome and (...) intolerable regulations, are instructions for better use of freedom, which if not followed, not only the freedom of everyone in the society will not be realized, but also the category it will become anti-value and create cultural chaos. Imam Ali (peace be upon him), during his rule period, not only did not limit the freedom of expression, but also emphasized the expansion of this freedom. Based on Islam, since man is a free being, the privacy of his freedom must always be preserved; Therefore, freedom is the natural right of every human being and cannot be taken away from him. The practical life of Imam Ali (PBUH) and his advice to his agents in caring for freedom of expression in society and politics, bring its importance to the fore. Considering the importance of this issue, the purpose of this research is to study freedom of expression in Islamic teachings with emphasis on Nahj al-Balagha. Based on this, the related themes to freedom of expression have been extracted and explained from the point of view of Nahj al-Balagha, and conclusions have been presented in this regard. Contribution: This research showed that in the Islamic system, all citizens have the right to freedom of speech in ideological, political and social issues (according to the limits set by Islamic teachings and prevent the violation of Islamic values and other human values). A documentary review was carried out on the production and publication of research papers related to the study of the variables Sustainable Tourism, Economic Development and Rural Destinations. The purpose of the bibliometric analysis proposed in this document was to know the main characteristics of the volume of publications registered in the Scopus database during the period 2018-2023, achieving the identification of 135 publications. The information provided by this platform was organized through graphs and figures categorizing the information by Year (...) of Publication, Country of Origin, Area of Knowledge and Type of Publication. Once these characteristics have been described, the position of different authors regarding the proposed theme is referenced through a qualitative analysis. Among the main findings made through this research, it is found that Spain, with 19 publications, was the country with the highest scientific production registered in the name of authors affiliated with institutions in that nation. The Area of Knowledge that made the greatest contribution to the construction of bibliographic material related to the study Sustainable Tourism, Economic Development and Rural Destinations, was Business, Administration and Accounting with 65 published documents, and the most used Type of Publication during the period indicated above were Journal Articles with 68% of the total scientific production. In 1956, as a young art critic, the Mexican philosopher Juliana González first encountered the paintings of the Spanish surrealist Remedios Varo at the artist’s breakthrough solo exhibition in Mexico City’s Galería Diana. González, greatly impressed, soon befriended the much older Varo and became a regular visitor to her studio, where they talked about her paintings and their shared intellectual interests in literature, psychoanalysis, and philosophy, a conversation that ended with Varo’s untimely death in 1963 at age 54. A (...) few years later, González contributed this essay-homage to the 1966 catalog Remedios Varo. She opens with an evocation of Varo’s masterpiece, the triptych To the Tower, Embroidering the Earth’s Mantle and The Escape —a magnet for viewers at the recent “Surrealism Beyond Borders” exhibition in New York and London—and finds in it keys to the artist’s life and to her attempts through art “to flee this inexorable order toward another reality.” González’s close examination of the contradictions and ambiguities in Varo’s artistry, of “her wise, poetic humor,” and of her quest “to comprehend the universe” remains an essential read almost 60 years later. The catalog in which it first appeared is long out of print, and, to the best of my knowledge, González’s essay has never been republished in Spanish, making the text that follows as much an act of recovery as it is a translation. Business Ethics: A European Review, EarlyView.

Moral distress has been well reviewed in the literature with established deleterious side effects for all healthcare professionals, including nurses, physicians, and others. Yet, little is known about the quality and effectiveness of interventions directed to address moral distress. The aim of this integrative review is to analyze published intervention studies to determine their efficacy and applicability across hospital settings. Of the initial 1373 articles discovered in October 2020, 18 were appraised as relevant, with 1 study added by hand search (...) and 2 after a repeated search was completed in January and then in May of 2021, for a total of 22 reviewed articles. This review revealed data mostly from nurses, with some studies making efforts to include other healthcare professions who have experienced moral distress. Education-based interventions showed the most success, though many reported limited power and few revealed statistically lowered moral distress post intervention. This may point to the difficulty in adequately addressing moral distress in real time without adequate support systems. Ultimately, these studies suggest potential frameworks which, when bolstered by organization-wide support, may aid in moral distress interventions making a measurable impact. (shrink)

The issue of the ordering of the ten trichotomies is one among the many questions still open regarding Peirce’s extended theory of signs. A proper decision regarding the order of the ten trichotomies demands a discussion of the entire semiotic process. The aim of this paper is to discuss the order of the trichotomies related to the mode of being of the immediate and dynamical objects. Therefore, it addresses only one part of this process, which concerns the relationship between the (...) sign and its objects. When subdividing the object, Peirce begins to consider the immediate and the dynamic objects as trichotomies, that is, aspects to be considered in the definition of the classes of signs. The introduction of these two trichotomies brings in a problem: how to order them in the system of ten trichotomies. Diverging opinions regarding this ordering are found in Peirce’s texts, and in his commentators. We will investigate this problem by seeking a sort of pragmatic clarification of the matter, presenting a reflection about the philosophical and semiotic consequences of the different proposals for the ordering of these trichotomies. Placing the dynamic object after the sign may even help to explain the functioning of fictional signs, but is this coherent with Peirce’s philosophy? On the other hand, would it be possible to talk about lying signs if every object was determined by its own sign? (shrink)

Lifestyle refers to a set of personal and group behaviours related to normative and semantic aspects of social life. Any coherent set of behavioural patterns derived from religious teachings that exist in life can be considered a religious lifestyle. Considering that the dominant religion in Jordan is Islam, the present study focused on the Islamic lifestyle. In addition, given that the correct relationship between couples has been compared to life-giving blood in marriage, and since the quality of marital role plays (...) a determining role, the existence of communication skills in any of the couples can generate satisfaction and compatibility, whereas lack of awareness of these skills could cause misunderstandings and tension. Therefore, the current study aims to study the role of the Islamic lifestyle in communication skills of 250 Muslim couples of Jordan (Amman, Zarqa and Irbid) in 2022. Data were collected using questionnaires during four months, and the validity and reliability was confirmed. In addition, data analysis was performed in Statistical Package for Social Sciences (SPSS) and Linear Structural Relations (LISREL) using mean tests and structural equation modelling. According to the results, Islamic lifestyle had a positive, significant effect on the improvement of communication skills in Muslim couples in Jordan (P-value: 0.76; T-value: 7.92). Therefore, it is recommended that more attention should be paid to this issue by families, researchers and cultural authorities in the country.Contribution: Our findings revealed that Islamic lifestyle improved communication skills in Muslim couples, which demands special attention. By adhering to the Islamic lifestyle, couples can influence each other’s knowledge, emotions, education and growth, and try to have a realistic understanding of each other’s desires, needs, living environment and perceptions that each has in life issues. Furthermore, they can organise their role in the common life in appropriate ways to prevent problems and solve them in the event of problems. (shrink)

En este artículo estudiaremos el vínculo entre las instituciones y el populismo mediante una experiencia concreta: la Asignación Universal por Hijo en la Argentina. Para ello, vamos a dividir el artículo en tres partes. Primero, desarrollaremos un tipo de abordaje metodológico específico: el procedimiento coyuntural recogido por Mouffe para pensar el actual momento populista. Segundo, explicitaremos el debate teórico alrededor del vínculo entre instituciones y populismo y las dificultades que existen para pensar esta relación. Tercero, partiremos del caso concreto de (...) la AUH, con objeto de mostrar sus tres momentos constitutivos: el surgimiento de la demanda popular, su apropiación y tramitación por parte del gobierno y la transformación de la demanda en un derecho. Finalmente, señalaremos, a partir del caso estudiado, cómo la conflictividad rupturista de la institucionalidad populista puede ayudarnos a pensar, transnacionalmente, una lógica alternativa al neoliberalismo.This article aims to study the relationship between institutional policies and populism analyzing the Universal Assignment for Child (AUH) in Argentina. To achieve this objective we will divide the paper in three sections. Firstly, we will think the populist moment in this particular setting as a method of interpretation. Secondly, we will follow the theoretical debates about institutions and populism explaining the difficulty to think this relationship. Third, from the concrete case of AUH, in order to show the constitutive moments: the emergence of popular demand, its appropriation and processing by the government and the transformation of demand into a right. Finally, we will show how the rupturist conflict of populist institutionalism helps us conceive a transnational alternative to global neoliberalism. (shrink)

In Soulmates: Resurrecting Eve, Juliana Geran Pilon argues for a return to an egalitarian view of men and women, found in the original Genesis narrative, as reflected through Judaism, Christianity, and Islam. In each of these Abrahamic traditions, it was understood that man and woman were created to be soulmates in God's image—equal despite their different functions within society. Pilon writes that this original message has gradually been distorted, with disastrous effect. Any hope for an ennobling human community begins (...) by resurrecting Eve as an equal partner to Adam. The work examines the Biblical creation narrative, comparing it to Greek and other ancient mythologies. Pilon explains how the disturbing association of woman with sin and death led to Eve's demise as Adam's equal. The final section of the work deals with the Goddess myth, love and marriage in early religious narratives, and modern man's search for his soul no less than for a soulmate. The book, at its core, is a meditation on the relationship between men and women but also among human beings. The resurrection of Eve is indispensable to attaining a true appreciation of love and faith. Pilon uses religious texts, expert commentary, and various works of fiction, poetry, and psychology to make her argument come alive. The work is strengthened by the writing style, alternately poetic and humorous, and a clear and illuminating progression of ideas. Its emphasis on reconciliation and understanding, and its post-feminist outlook will find a receptive audience. (shrink)

Research on unethical leadership has predominantly focused on interpersonal and high-intensity forms of harmful leader behavior such as abusive supervision. Other forms of harmful leader behavior such as excessively pressuring subordinates or acting in self-centered ways have received less attention, despite being harmful and potentially occurring more frequently. We propose a model of four types of harmful leader behavior varying in intensity and orientation : Intimidation, Lack of Care, Self-Centeredness, and Excessive Pressure for Results. We map out how these relate (...) to other constructs in the unethical leader behavior field in order to integrate the existing work on how leaders can cause harm to followers. Next, in five studies, we develop and test a new survey instrument measuring the four proposed types of perceived HLB. We provide initial validity evidence for this new measure, establish its psychometric properties, and examine its nomological network by linking the four types of HLB to related leadership constructs and soft and hard outcome correlates at the individual and team level. We find that HLB is negatively related to constructive forms of leadership and positively to unethical ones. HLB is also related in the expected direction to job satisfaction, engagement, psychological safety, knowledge sharing, knowledge hiding, deviance, and objectively recorded team-level stress-related absenteeism. Zoning regulations are the most ubiquitous of the land use laws in the United States, as well as in many other countries. As such, they have far-reaching effects on the location of noxious uses, and any concomitant environmental or human health impacts.Zoning has enormous implications, (...) in general, for shaping our environment, and because changes to zoning are made through a political process, it has possibilities for abuse. One zoning expert stated:I suppose what really disturbs me is that because zoning is the most universal of the legal tools for shaping the character of the municipality, any unwise use of the process has a far greater impact upon our national character than does the abuse of a less widely employed device. The moral community is a social community, and as such it is vulnerable to social problems and pathologies. In this essay I identify a particular way in which participation in the moral community can be constrained by social factors. I argue that features of the social world—including power imbalances, oppression, intergroup conflict, communication barriers, and stereotyping—can make it nearly impossible for some members of the moral community to hold others responsible for wrongdoing. Specifically, social circumstances prevent some marginalized people from (...) engaging in what Stephen Darwall calls “felicitous moral address” (Darwall 2006). We should think of some members of the moral community as having “second-class moral citizenship” in ways that parallel second-class political citizenship. The injustice of second-class moral citizenship can be understood by drawing an analogy with Miranda Fricker’s notion of “epistemic injustice” (Fricker 2007). Fricker’s account of how people can be undermined in their capacity as knowers can be extended to show how people can be undermined in their capacity as makers of moral claims, which can be called “claimant injustice”.
